Terms of Use
These terms apply when you use the Innovative College Prep website and its free tools, and to the complimentary advising consultation. Please read them, especially the sections on estimates, warranties and limits on liability. By using the site, you agree to them. If you don’t agree, please don’t use the site.
Who these terms cover
These terms are an agreement between you and Innovative College Prep, LLC, a Florida limited liability company (“ICP”, “we” and “us”), which operates this website at innovativecollegeprep.com and provides its free tools and private advising. “You” means anyone who uses it, including students, parents and guardians, counselors and other educators. ICP is a general-audience educational website. If you are under 18, please review these terms with a parent or guardian. A parent or guardian who uses ICP with or for a minor accepts these terms for themselves and, where the law allows, for that minor. Students under 13 should use ICP with a parent, guardian or teacher.
Educational information, not professional advice
ICP provides general educational information and planning tools. Nothing on the site is admissions, financial-aid, financial, tax or legal advice, and using the site does not create an advisory or other professional relationship. Decisions about applications, enrollment, financial aid and borrowing are yours. Don’t rely on ICP alone for them: confirm important information with the college, your school counselor or another qualified professional.
Data, estimates and accuracy
College information comes from public sources such as federal datasets and colleges’ own publications, including Common Data Set reports and cost-of-attendance pages, labeled with its source and reporting period. ICP reviews those sources, checks the figures it publishes against them, and leaves out figures that are ambiguous, conflicting or could not be confirmed, as described in Sources & methodology. That review is not an audit or certification: ICP relies on what the sources published. Sources can be incomplete, out of date or later revised, colleges change their requirements, deadlines and costs, and ICP can make mistakes in collecting or presenting information.
Cost figures, budget scenarios, GPA calculations, Fit matches, rankings, labels and other results are estimates or summaries based on the available information, ICP’s published methods and the inputs you provide. They are not offers, quotes, official determinations or a college’s own assessment. ICP works to keep its information accurate but does not guarantee that it is complete, current or error-free. Rely on each college’s official information and on any aid offer you actually receive. If you spot an error, please tell us.
No outcome guarantees
ICP does not guarantee admission, scholarships, financial aid, test results or any other outcome. No ranking, match, estimate or roadmap on the site predicts or promises a result.
Your plan is stored in your browser
ICP’s planning tools keep what you save in your own browser’s storage, not on ICP’s servers, so ICP cannot see, recover or restore it. It can be lost if browser data is cleared, a device is lost or replaced, a browser or school policy removes it, or storage fails. It is not encrypted, and others using the same browser profile, including on shared or school-managed computers, may see it.
You are responsible for keeping copies you want, using the backup tools, and removing your plan from shared computers. Import only backup files you created or trust: ICP checks a file’s format, not whether its contents are accurate. ICP is not responsible for the loss of, or access by others to, information stored in your browser or in files you download, import or share.
Acceptable use
Use ICP lawfully and for its educational purpose. Do not interfere with or disrupt the site or its hosting; probe, scan or try to bypass its security without authorization; use automated tools to copy substantial parts of the site or its data files, or in a way that places an unreasonable load on it; copy substantial parts of it to offer a competing or commercial service; misrepresent ICP’s content or its source; or suggest that ICP, a college or a school endorses you, your organization or your product when it does not. ICP may limit or block access that violates these terms.
Intellectual property
ICP’s original text, guides, worksheets, design, software, branding and its selection and presentation of information belong to Innovative College Prep, LLC or its licensors and are protected by copyright and other laws. You may use, print and share them for personal, non-commercial educational purposes, and schools and counselors may share and print them for their students, with credit to Innovative College Prep. Any other use, including republishing or selling ICP content, requires ICP’s written permission.
Public data from federal agencies and other sources is not ICP’s, and ICP claims no ownership of it. It remains subject to its own terms, which are credited where it appears. College names, and names such as Common App, College Board and the Common Data Set, belong to their owners and are used only to identify them. Their appearance on ICP does not mean they endorse or are affiliated with ICP. If you send ICP suggestions about the website, ICP may use them without any obligation to you.
Schools, counselors and districts
Schools, counselors and districts may link to ICP and print or share its resources as described above, free and without a contract. That use does not make ICP a school’s contractor or service provider, and ICP receives no student records from schools. A school’s link to ICP does not mean the school endorses ICP or any paid service it offers, and ICP does not claim any school’s or district’s approval. Please follow your school’s or district’s policies on recommending outside websites. No written agreement with any school or district is in place unless one has been signed.
Links and third-party services
ICP links to colleges, government agencies and other websites, and some features open services run by others, including the scheduling and meeting services used for private advising. Those sites and services are not controlled by ICP and have their own terms and privacy practices. ICP is not responsible for their content, availability or practices.
Private advising
Private advising is a separate, optional paid service offered by Innovative College Prep, LLC. ICP’s free tools do not require it. The advising page describes the service in general terms; it is not an offer of specific services, fees or results.
A paid engagement begins only under a separate written client agreement with Innovative College Prep, LLC that sets out its services, fees, payment, cancellation, refunds, confidentiality, limits on liability and other terms. That agreement governs paid advising, and the website disclaimers and liability limit below do not apply to it.
The complimentary introductory consultation creates no obligation and no advising relationship, and it does not begin a paid engagement. It is a general conversation about the student’s goals and whether advising is a good fit, not individualized admissions, financial-aid, financial or legal advice, and decisions remain the family’s. Because it is free, these terms apply to it, including the disclaimers and liability limit below.
No one can guarantee an admission, scholarship or financial-aid result, and ICP does not promise one. Essays and application materials remain the student’s own work.
Advising questions and consultation bookings are for parents and guardians, and for students who are 18 or older. When the student is under 18, a parent or guardian arranges advising and any consultation and is the party to any advising agreement.
Scheduling and meetings use third-party services (currently Calendly and Google Meet) under their own terms.
Questions about these terms can be sent to innovativecollegeprep@gmail.com.
Disclaimer of warranties
To the fullest extent permitted by law, the website, its free tools and the complimentary introductory consultation are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. No information from ICP creates a warranty that these terms do not state. Some jurisdictions do not allow certain exclusions, so some of these may not apply to you.
Limitation of liability
The website, its free tools and the complimentary introductory consultation are provided without charge. To the fullest extent permitted by law, Innovative College Prep, LLC and its members, managers, employees, agents and contractors are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost data, lost opportunities (including admission, scholarship or financial-aid opportunities) or lost profits, arising from or related to your use of, or inability to use, the website, its free tools and the complimentary introductory consultation. This applies whatever the legal theory, including contract, negligence or other tort, and even if ICP was told such damages were possible. For the website, its free tools and the complimentary introductory consultation, their total liability for all claims combined is limited to US$100.
This section does not apply to paid advising, which is governed by its written agreement. It does not limit anyone’s liability for their own fraud, gross negligence or intentional misconduct, or any liability or right that cannot be limited or waived under applicable law, including consumer-protection laws and protections the law gives minors.
Questions and concerns
If you have a question or concern about the website or these terms, please contact ICP first at innovativecollegeprep@gmail.com, so we can try to resolve it informally.
Governing law
These terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. This does not take away any protection that the law where you live gives you and that cannot be waived by agreement, including consumer-protection laws and protections for minors.
Changes
ICP may update, change, suspend or discontinue any part of the website. ICP may also update these terms. Updated terms are posted on this page with a new effective date and apply to your use of the site from then on. They do not change the terms that applied to a dispute that arose before they were posted.
General
If any part of these terms is found unenforceable, it will be enforced to the extent permitted and the rest remains in effect. ICP’s failure to enforce a provision is not a waiver of it. Sections that by their nature should continue, including those on intellectual property, disclaimers and limits on liability, continue to apply after you stop using the site. These terms and the Privacy Policy are the entire agreement between you and ICP about the website, its free tools and the complimentary introductory consultation. Paid advising is governed by its own written agreement.
